Early Morning Dump LLC – VIP Package Terms & Conditions

These Terms & Conditions (“Agreement”) govern participation in the VIP Package (Residential) (“VIP Membership”) offered by Early Morning Dump LLC (“Company,” “we,” “our,” or “us”). By enrolling in the VIP Membership, you (“Member,” “you,” or “your”) agree to the following:

1. VIP Membership

1.1. Membership Fee: The VIP Membership is billed at $50 per month, automatically recurring until canceled by the Member in accordance with Section 8.
1.2. Eligibility: Membership is limited to residential customers only. Commercial accounts require a separate agreement.
1.3. Non-Transferable: Membership benefits are for the enrolled Member’s residential property only and cannot be shared, transferred, or resold.

2. VIP Benefits

VIP Members are entitled to the following:

• 10% Discount on Dumpster Rentals (as reflected in VIP Pricing Schedule).
• Guaranteed Time Scheduling for deliveries, swaps, and pickups based on Member’s chosen times (subject to Section 6: Limitations).
• Priority Same-Day Service for orders placed before [Insert cutoff time, e.g., 10:00 AM].
• 1 free swap a month
• Emergency Swap-Outs prioritized over non-VIP customers.

3. VIP Pricing

The following discounted VIP pricing applies (already reflecting the 10% discount):

4. Payment Terms

4.1. Membership Fee: Billed monthly via the payment method provided at signup.
4.2. Rental Charges: Dumpster rental fees, overage charges, and additional services are billed separately and must be paid in full prior to or at the time of service.
4.3. Late/Failed Payments: Failure to maintain an active payment method may result in suspension of VIP benefits or termination of membership.

5. Use of Dumpsters

5.1. Prohibited Materials: Hazardous waste, chemicals, flammable materials, tires, batteries, medical waste, and other restricted items are not permitted. Member is responsible for ensuring proper use.
5.2. Weight Limits: Member is responsible for all overweight charges as outlined in Section 3.
5.3. Placement & Access: Member must provide clear, safe access for delivery, pickup, and swap services.

6. Limitations

6.1. Service Guarantee: While VIP Members receive priority scheduling, services may be delayed due to unsafe conditions, road closures, inclement weather, or other circumstances beyond the Company’s control.
6.2. Service Area: VIP Membership benefits apply only within the Company’s designated residential service area. Additional charges may apply for extended distances.

7. Liability

7.1. Property Damage: The Company is not liable for damages to driveways, lawns, curbs, landscaping, or underground utilities resulting from placement or use of dumpsters.
7.2. Indemnification: Member agrees to indemnify and hold harmless the Company from claims, damages, or liabilities arising from improper use of dumpsters or violations of these Terms.

8. Membership Term & Cancellation

8.1. Term: Membership is month-to-month and automatically renews.
8.2. Cancellation by Member: Member may cancel at any time with 30 days’ written notice. No partial refunds will be issued for unused membership periods.
8.3. Termination by Company: The Company may suspend or terminate membership for non-payment, misuse, or violation of these Terms.

9. Modifications

The Company reserves the right to update or modify these Terms, membership fees, or benefits at any time. Members will be notified in writing at least 30 days prior to any material change.

10. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of the State of [Insert State].

Early Morning Dump LLC – Dumpster Rental Terms & Conditions

By renting a dumpster from Early Morning Dump LLC (“we,” “our,” “us”), you agree to the following Terms & Conditions. Please read them carefully before booking.

1. Rental Periods

• Standard rental periods are available in 1-day, 3-day, 5-day, and 7-day options unless otherwise stated.
• Additional days may be added at $20 per day.
• Failure to notify us of rental extensions may result in additional charges.

2. Delivery & Pickup

• Dumpsters will be delivered and picked up on the agreed dates.
• Service times are not guaranteed and may be affected by weather, traffic, road closures, or landfill availability.
• Customers must provide clear, safe access to the delivery location. If access is blocked, a dry run fee may be charged.

3. Pricing & Payment

• Pricing includes delivery, pickup, and disposal up to the included tonnage listed in your rental agreement.
• Overage fees apply at $100 per ton beyond the included limit.
• Payments must be made in full at the time of booking, unless otherwise arranged.
• Accepted payment methods are listed on our website.

4. Weight Limits & Overage Fees

• Each dumpster includes a set tonnage limit (varies by dumpster size).
• Overweight loads will be charged at $100 per ton over the included amount.
• If the landfill scale weight is disputed, the landfill ticket will serve as the official record.

5. Prohibited Items

The following items are not allowed in our dumpsters:

• Hazardous waste or chemicals
• Paints, oils, and liquids
• Tires and batteries
• Appliances containing Freon
• Asbestos or other regulated materials
• Items restricted by local, state, or federal law

Customers who place prohibited items in the dumpster may be subject to additional disposal fees or fines.

6. Loading Requirements

• Dumpsters must not be loaded above the top of the dumpster.
• Loads must be safe and transportable.
• Overloaded dumpsters may result in additional charges or refusal of service until corrected.

7. Surface & Property Damage

• Dumpsters are heavy and may cause damage to driveways, asphalt, concrete, or lawns.
• Customers are responsible for protecting their property (e.g., using boards or pads).
• Early Morning Dump LLC is not liable for surface or site damage unless caused by gross negligence.

8. Customer Responsibilities

• Ensure the dumpster is placed on a safe, accessible surface.
• Keep the area clear for delivery and pickup.
• Do not move the dumpster once placed.
• Customer is responsible for the contents of the dumpster during the rental period.

9. Cancellations & Refunds

• Cancellations made at least 24 hours before delivery may be eligible for a partial refund.
• Same-day cancellations may result in a service fee.
• No refunds will be issued once the dumpster has been delivered.

10. Liability

• Customer assumes full responsibility for injuries or damages resulting from improper use of the dumpster.
• Early Morning Dump LLC is not liable for indirect or consequential damages arising from dumpster use.

11. Governing Law

• These Terms & Conditions are governed by the laws of the State of Indiana.
• Any disputes will be resolved in the courts of Johnson County, Indiana.

By booking a dumpster through our website, you confirm that you have read, understood, and agree to these Terms & Conditions.
