Terms and Conditions of Rental
By clicking “Agree,” Renter agrees to all terms and conditions stated herein. These Terms and Conditions (“Terms”) govern the rental of any dump trailer (“Trailer”) from Early Morning Dump LLC (“EMD”). By booking, accepting delivery, or signing any rental document, the customer (“Renter”) agrees to be legally bound by these Terms.
1. RENTAL OF EQUIPMENT
EMD agrees to rent to Renter a dump trailer (“Trailer”) in the size selected at booking. The Trailer remains the sole property of Early Morning Dump LLC at all times.
2. PERMITTED USE
The Trailer may be used only for the disposal of non-hazardous solid waste including:
- Household junk
- Construction debris
- Remodeling materials
- Roofing materials (within weight limits)
- Furniture
- Wood
- Drywall
- Non-contaminated general debris
3. PROHIBITED MATERIALS
The following items are strictly prohibited:
- Hazardous waste
- Chemicals
- Paints, solvents, oils, fuels
- Asbestos-containing materials
- Tires
- Batteries
- Refrigerators, AC units, or appliances containing Freon (unless pre-approved and Freon Drained)
- Medical waste
- Explosives or flammable materials
- Liquids of any kind
- Concrete, brick, dirt, or heavy aggregate unless specifically approved
- Any material prohibited by Indiana law or landfill regulations
If prohibited materials are found:
- Renter agrees to pay all landfill rejection fees
- Renter agrees to pay all hazardous material handling fees
- Renter assumes full legal and financial responsibility
4. WEIGHT LIMITS & OVERAGE CHARGES
Each Trailer size includes a specific tonnage allowance communicated at booking.
If Renter exceeds the included tonnage:
- Renter agrees to pay $100 per ton over the included weight limit.
- Weight is determined by certified landfill scale tickets.
- Renter authorizes EMD to charge the card on file for overweight fees.
5. OVERFILLING POLICY
Renter may NOT load debris above the side walls of the Trailer.
- Material must remain level with the top rails.
- No debris may extend above the height of the trailer sides.
If overloaded:
- Renter must remove excess debris before pickup
OR - Renter agrees to pay a $100 violation fee and any additional trip fees if required.
EMD reserves the right to refuse pickup of unsafe loads.
6. PLACEMENT & MOVEMENT
Once the Trailer is delivered and detached from EMD’s truck:
- Renter assumes full responsibility for the Trailer.
- If EMD must return to reposition or move the Trailer, Renter agrees to pay a $100 service charge per occurrence.
7. SWAP FEES
If Renter requests replacement of a full Trailer with an empty Trailer:
- Renter agrees to pay the applicable Swap Fee based on trailer size, as published on earlymorningdumpllc.com or provided at booking.
- Swap fees are in addition to the original rental rate.
8. RESPONSIBILITY & LIABILITY
Once the Trailer is placed and detached:
- Renter is fully responsible for the Trailer and lock.
- Renter assumes all risks of theft, damage, vandalism, fire, or misuse.
- Renter is liable for the full cost of repair or replacement.
- Renter agrees to pay for any damage to:
- Trailer structure
- Axles
- Tires
- Hydraulic systems
- Gate
- Locking mechanisms
Renter agrees to pay the total cost of repairs as determined by a licensed repair facility.
9. LOCK RESPONSIBILITY
If a lock is provided:
- Renter is responsible for its safekeeping.
- Lost, cut, or damaged locks will be charged at replacement cost.
10. ACCESS & PROPERTY DAMAGE
Renter represents that:
- The delivery location is safe and accessible.
- Ground conditions can support the weight of the Trailer and truck.
- EMD is not responsible for damage to:
- Driveways
- Sidewalks
- Concrete
- Asphalt
- Landscaping
- Underground utilities
Renter assumes all risk related to placement location.
11. PAYMENT TERMS
- Full payment is due at booking unless otherwise agreed.
- Renter authorizes EMD to charge the card on file for:
- Overage fees
- Swap fees
- Service charges
- Damage repairs
- Violation fees
- Landfill surcharges
Failure to pay may result in:
- Collection action
- Attorney fees
- Court costs
- Interest at the maximum rate allowed by Indiana law
12. INDEMNIFICATION
Renter agrees to indemnify and hold harmless Early Morning Dump LLC from any claims, damages, injuries, fines, penalties, or legal actions arising from use or misuse of the Trailer.
13. GOVERNING LAW & VENUE
This Agreement shall be governed by the laws of the State of Indiana.
Any dispute shall be resolved in a court of competent jurisdiction located in Indiana. Renter agrees to venue in Indiana and Johnson County.
14. ENTIRE AGREEMENT
This Agreement constitutes the entire understanding between the parties. No verbal agreements shall modify its terms.
